Our Mumbai CAT court case Judgment has pronounced today by Honble. Justice Smt. Mujumdar, & Justice Smt. Bhamsi.

Court directed BSNL to Regularize the Officiating JTO’s in 35% quota unfilled vacancies for the year 2000 & 2001.

12 weeks time is given to implement the order.

Court further directed to maintain statuesque in the present posting of the applicants.

 We congratulate all Officiating JTO’s and appeal to strengthen our unity to get the order implemented in good spirit, and defeat the unethical and illegal provisions in the New JTO RR-2014. by introducing additional  Phase-I Training to the Officiating JTO’s, who have completed Phase-I Training in the year 2005 and working as JTOs for more than 10 years,  and provision related with the seniority favoring the  Direct recruited TTA’s.

We also expressed our sincere thanks to our Advocate Shri. K. Balsubramanium and all officiating JTOs who supported during the court case proceedings.

Respected Sir,

          At the outset I am thankful to you for the decision of BSNL Board for absorption of Screen Test qualified and JTO Phase-I Trained Officiating JTO’s against 50% Promotion Quota.

          However in the Note-5 of schedule of JTO (T) RR-2014 it is mentioned that, “The officials who had been appointed on regular basis under old JTO (T) Recruitment Rules shall be unblock senior to those appointed / Regularized through new recruitment rules on regular basis.”  Which is contrary to the para-11 of terms and conditions of absorption, circulated vide letter No. referred here in above.

          As per the recorded discussion, held with three federations on 02/01/2001, on the proposal approved there in para-11, which is reproduced below, clearly shows that, “The group C&D employees who appear for any promotional examination whether direct or departmental and qualify in such examinations./ Outsiders coming through direct recruitment process, would rank junior to all other employees in the promotional cadre who had already been qualified in the earlier examination even though they get absorbed in BSNL subsequently”.

   “

          Therefore, since I have qualified in the Screen-test held on 28/04/2000, the earlier examination, shall rank senior to all who appeared promotional exam whether direct or departmental and qualified in such exam, shall rank junior to me.

          Since the R.R. 2014, Note-5, scheduled is contrary to the terms of my absorption in BSNL. This condition in R.R. should be deleted and justice done to me.

          Further, since I have already underwent JTO Phase-I Training in the year 2004-2005, and also continuously working as JTO for more than 10 years with Technical Break of one day after every 180 days. I request you to kindly scrap the condition of undergoing in fructuous JTO Phase-I training again. In case any knowledge of any latest technology is required to be imparted, this can be done by giving in service training or by adding this subject in the Second Phase of JTO training which I have to undergo after my absorption as regular JTO.

          Kindly consider my submission favorably and amend the R.R. accordingly and oblige.

We have meeting with our Advocate on 18^th Oct. 2015, regarding the unethical and illegal provisions in the New JTO RR-2014. by introducing additional  Phase-I Training to the Officiating JTO’s, who have completed Phase-I Training in the year 2005 and working as JTOs for more than 10 years,  and provision related with the seniority favoring the  Direct recruited TTA’s.

Advocate advised that to,

First send the individual request representation to Hnbl. CMD BSNL for removal of the Note 5 Scheduled in the New JTO RR-2014.

And scraping the condition of undergoing in fructuous JTO Phase-I Training again.

Copy of the representation is available on the blog and also through Mail. Make two copies of it and send one copy through proper channel & one advanced copy directly by post to Hnbl CMD BSNL , Harishchandra Mathur Lane, Janpath, New Delhi-110001.

If our request is not considered we will, explore legal and other available options.

Myself & Shri. B. D. Ghuge visited the BSNL Corporate Office on 14^th Oct. 2015, for the inspection of records related to RTI application.

We are very thankful to Shri. A. K. Singh, AGM (Estt-IV), & Shri. Sanjay Kumar,  Asst. Gen. Manager - Estt BSNL Corporate office, for their kind co-operation.

We have got all the information which was available in the file but not supplied by the BSNL Authorities besides the order of Chief Information Commissioner, New Delhi related to the Civil Writ Petition No. 5608 of 2007 in Punjab & Haryana High Court.

We also met Shri. Pralhad Raiji, Hnbl General Secretary AIBSNLEA and discussed about the proposed injustice by introducing additional  Phase-I Training to the Officiating JTO’s, who have completed Phase-I Training in the year 2005 and working as JTOs for more than 10 years, in the name of amendment of New JTO RR-2014.

 Chennai High court, in its Judgment, suggested for regularization of Officiating JTO’s in the unfilled vacancies for the Year 2000 & 2001, before introduction JTO RR-2001.

 Mumbai CAT case & Principle CAT, New Delhi case decision is expected any time.

We Also requested him for implementation of FR-22 (1) (a) (i) pay fixation to all Officiating Jto’s including MHT Circle.

We are continuously in touch with Shri. R Adam, Tamilnadu circle. We have exchanged the available documents with each other for further perusal of the Chennai High court Judgment for regularization of Officiating JTO’s in the unfilled vacancies for the Year 2000 & 2001 in Supreme Court.

It is mutually decided that, I’m, along with our representative, going to visit the BSNL Corporate Office on 14^th Oct. 2015. at 10.30 Hrs, for the inspection of records related to RTI application.

Today I have received the communication from BSNL Corporate office.

As per CIC decision no. CIC/BS/A2014001953/8480 DTD. 01/09/2015

“For the inspection of record related to RTI application, you are informed that you may inspect the relevant records relating to your case on mutually fixing convenient time and date with Shri. A. K. Singh AGM (Estt-IV) on Tele.no. 011-23734152  for the same.”

I have telephonic talks with Shri. A. K. Singh AGM (Estt-IV) on Tele. No.  011- 23734152, I explained him the reason for inspection of records related with our case, and injustice made with officiating JTO’s.

We may visit the corporate office in next week.

Our Mumbai CAT Court result is also expected in this week.
