Maharashtra Circle Officiating JTO's order released
BSNL Mgt has now openly came up for favouring DR recruited TTA,s in their proposed posting by ignoring the Right of Officiating JTO's.
Regularization is our right and we will get it with honour and dignity. Be patient and united. We are living in democratic India.
The approach of the BSNL Management is arbitrary and biased, favouring one group of employees even by protecting them for their fraudulent activities.
And at the same time ignoring legitimate Right of another group of employees. Not even file reply in the court cases field by the Officiating JTO,s in different courts.
BSNL Management has ignored Agreement with Three Federations, which is a violation of Absorption Terms and Conditions of Gr. C&D employees.
The civil rite petition no. 5608 of 2007 filed by DR TTA’s in Chandigadh High Court is like IPL Cricket Match( Court Case) Fixing.
Advocate Shri. Ahuja advise us to file Review petition in Chandigadh High Court against the decision in the civil rite petition no. 5608 of 2007. Before Honbl. High court for the states of Punjab & Har) Dalbir Singh & others petitioners Vs. BSNL Ltd. & others, with request for an Order to the BSNL for Vigilance inquiry, on the grounds of documentary evidence of False service details submitted to the court by applicants. The decision based on the fraudulent information has adversely affected to the 2000 Senior employees all over India.
He also asked us to get some information from CGMT Haryana who was dealing with the case for BSNL under RTI 2005.
The said information is not provided by CGMT Haryana . Therefore we have made appeal before Chief Information commissioner Of India. Shortly we will get the information and then we may approach to Chandigadh High Court against and for review of the decision in the civil rite petition no. 5608 of 2007.
Our Second appeal under RTI Act 2005 is stands before Chief Information commissioner New Delhi. Since 25th Sept. 2013.

Information required
a) Copy of affidavits in reply field in the civil rite petition no. 5608 of 2007. Before Honbl. High court for the states of Punjab & Har) & others petitioners Vs. BSNL Ltd. & others. After the judgement on 30th May 2008, the advice / opinion / Instructions / Guidelines given by,
i) BSNL Council
ii) BSNL Corporate Office legal wings correspondence with CGMT Haryana to be provided.
c) Copy of Note sheet & the correspondence with reference to the communication referred above made with Corporate Office..
Copy of Note sheets for letter & all correspondence culminated the decision for implementing the court order of High Court Punjab & Haryana without filing SLP in Supreme Court.
8) Brief facts of the case
A Civil Rit petition was field by 8 Telecom Technical Assistants (TTA’s) of BSNL Haryana Circle at Punjab & Haryana High Court.
The outcome of the case has affected the promotion of about 2500 senior TTA’s all over India including the applicant, due to the suspected mishandling of the case by the CGMT Haryana BSNL hence the information were sought.

) Reason Grounds for this appeal
The information sought was refused by the CPIO & First Appellate Authority under section 8(1) (h) of the RTI Act.2005 and also stated that the disclosure will not be in the interest of BSNL/ Dept. as case is pending and it is subjudice.
Reason given for refusal of information is not tenable as there is no
investigation or apprehension of prosecution of offender is involved in this court case, and also merely by providing this information, there is no act of subjudice on the part of CPIO & First Appellative Authority.
