INDIFFERENT ATTITUDE OF BSNL MANAGEMENT TOWARDS DOT
RECRUITED STAFF
Respected Sir,
We the most humble employees of BSNL who discharging
duties as Officiating JTOs at par with regular JTOs for more than eight years
are at a loss to observe indifferent attitude of BSNL management to fulfill its
own commitment on regularization of Officiating JTOs made on 31-03-2001.
Certain
officers of Management in collusion with Direct Recruited TTA’s and their illegal
Association named SNATTA. (No cadre union/association is allowed to form in
group C &D as per Trade union recognition Rules of BSNL) acted willfully
for defeating BSNL Board decision about regularization of officiating JTO’s. Following
facts will enlighten the real dark face of BSNL Mgt. and their involvement in
showing favoritism to the group of direct recruited TTA’s .
Shri. Dalbir Singh & Eight Direct recruited TTA’s of Punjab circle
filed case in High Court of Punjab and Haryana against BSNL
Board decision of Diversion of outsider quota for absorption of Officiating JTO’s , who has qualified in Screen Test, on the grounds that, the diversion of the post
caused injustice to them, as BSNL Mgt. is not conducting LICE for promoting
to JTO post, for which they are being
eligible and waiting since 2002.
They even misguided court by producing
fraudulent information about their number of years of service as 20 years &
15 Years and only because of diversion process their future is adversely
affected. Infact on the date of filing
Rit Pition or even on the date of judgment, the petitioners did not possess the
minimum requisite service of 10 years to appearing for JTO LICE at that time.

applicants received through RTI 2005, is

It is to be noted that all the
petitioners in the CWP
entered in the Department in the year 2002 only and they possessed less than 5
years service at the time of filing the petition
The CGMT Haryana who was dealing with the rite Petition in High
court on be half of or BSNL authenticated the fraudulent information submitted
to the court in collusion with the 8 Direct Recruited TTA’s. Without coating
and producing the factual information after verifying the service records of
the applicant TTA’s who has actually put less than 5 years of service and not even eligible
to appear in LICE.
Actually the court
case went against BSNL Board’s decision due to the collusion and conspiracy of
the BSNL Management of CGMT Haryana unit with 8 applicants.
However on 04/11/2008
pursuant to the High Court of Punjab and Haryana Orders dated. 30/05/2008 in CWP 5608 /2007, BSNL Managing Committee in its 104th Meeting
has decided –
a) There will be no further Diversion of Direct Rect. Quota Posts to
35%. Deptl. Quota.
b) As a Special measure BSNL has Created 3500 Supernumerary Posts of
JTO’s to accommodate 3500 Screening Test qualified TTA’s who were promoted
earlier as JTOs’ between the Years 2001 and 2007
c) BSNL Management further diverted 500 posts of JTO from outsider
quota to Deptl. Quota to create an opportunity for. Dalbir Singh & gang to
file Contempt of Court case against our Organization BSNL.
d) BSNL Management has violated
Rule 14 & 16 Of Constitution of India by creating only 3500 Supernumerary Posts of JTO’s to accommodate
3500 Screening Test qualified TTA’s who were promoted, leaving behind 2000 qualified candidates in the same Screening
Test conducted in the year 2000 by the DOT.
Various representations were made to the BSNL Management
unfortunately some of the officers of
BSNL, collide with Direct recruited TTA’s and reduced the number of
years required for appearing to LICE from 10 years to 7 years and conducted
LICE in March 2013. Now I apprehend that some officers in BSNL is trying to
undermine the terms and conditions for absorption agreed with Three Federations
on 2nd Jan 2001, according to which,
“The group C&D employees who
appear for any promotional examination whether direct or departmental and qualify
in such examinations./ Outsiders coming through direct recruitment process,
would rank junior to all other employees in the promotional cadre who had already
been qualified in the earlier examination even though they get absorbed in BSNL
subsequently”.
I am now afraid that certain
officers in BSNL is contemplating to post these TTA’s who has cleared
2013 LICE Exam after JTO Training without absorbing left out 2000 TTA’s who qualified in
earlier Screen Test of 2000, and senior to these group of TTA’s in violation of the
Terms and conditions of absorption. Therefore I request, I may be promoted immediately before issuing
the promotion order of these TTA’s who cleared 2013 Exam.
I also request to fix
responsibility on the officers who willfully not filed correct and factual
information about service particulars of the 8 petitioners who field the case.
Since the petition is solely related with their length of service for appearing
LICE Exam.
One of the Associations (AIBSNLEA) did
demand an enquiry in the matter in April 2012 but management has done nothing
till today.
We request your honor to look into the
matter and compel the BSNL Management to act according to constitution of India,
and do justice with us.
And vigilance inquiry of whole proceeding
related with CWP 5608 /2007 High Court of Punjab and Haryana
