Today I have received the communication from BSNL Corporate office.

As per CIC decision no. CIC/BS/A2014001953/8480 DTD. 01/09/2015

“For the inspection of record related to RTI application, you are informed that you may inspect the relevant records relating to your case on mutually fixing convenient time and date with Shri. A. K. Singh AGM (Estt-IV) on Tele.no. 011-23734152  for the same.”

I have telephonic talks with Shri. A. K. Singh AGM (Estt-IV) on Tele. No.  011- 23734152, I explained him the reason for inspection of records related with our case, and injustice made with officiating JTO’s.

We may visit the corporate office in next week.

Our Mumbai CAT Court result is also expected in this week.

We have received the Certified Copies of C.O.C.P No.1431 OF 2008 from The Registrar of Punjab & Haryana High Court on 22^nd Sept.2015.

Received documents contained the very clear information about the JTO Promotion sandal operated by the 8 fraud applicants TTA’s and their Association SNATTA with the help of Shri. S.K. Bharadwaj,  Assistant General Manager (Legal), BSNL O/o CGMT Haryana, and  Shri. P. M. Varma, Assistant General Manager (Pers- IV), BSNL O/o CMD BSNL.  New Delhi.  And some other officers of CGMT Haryana & BSNL Corporate office.

In the Received documents we also got the copy of the affidavit filed by Shri. Kuldeep Goyal then CMD BSNL, he admitted in his affidavit that along with 8 applicants Shri. S. K. Bharadwaj, Assistant General Manager (Legal), BSNL O/o CGMT Haryana, submitted incorrect information to Punjab & Haryana High Court during the proceedings of Civil Writ Petition No. 5608 of 2007.

The copy of received documents is send to our Mumbai High Court Advocate.

Shortly we will meet our Advocate to discuss about  further legal action in the present situation.

Hearing on our complaint against CPIO of BSNL CGMT Haryana & CPIO BSNL Corporate Office is successfully concluded on 1^st September 2015.under RTI Act 2005.

We express our sincere thanks to Honbl Central Information Commissioner, Sri. Basant Seth, for his kind justice.

G.M.BSNL Corporate office has send nine pages of information on 31^st August 2015. One day before hearing.

After verification of information received we found that some specific information is still not supplied.

During the hearing on 1^st September 2015, I informed Chief Information Commissioner hon’ble Shri Basant Seth, that as there is definite possibility of big underhand dealing between the beneficiaries of the decision and the some officers of CGMT Haryana & BSNL Corporate office and therefore the complete information is not supplied besides Chief Information Commissioners order.

And both the CPIO’s should not be allowed to defeat the purpose of the RTI Act 2005.

Shri. D.K. Puri CGMT Haryana CPIO explained that they have supplied total information available with them.

After hearing both, Honbl.CIC ordered for,

Personal inspection by the applicant and or his representative of all information available in the file at BSNL Corporate office and CGMT Haryana office files and getting the photo copies of the required information if available in the file but not supplied by the CPIO.

Honbl. CIC further also advised to approach to the court for order of an inquiry, if not satisfied after the personal verification of information available in the file records.

            Be please to furnish me with certified copy of Writ Petition in COCP No. 1431 of 2008, and Judgment passed by his Lordship HON’BLE MR. JUSTICE AJAY TEWARI, also copies of documents attached by the applicants, reply field by Respondents, Rojnama and all documents submitted by applicants and Respondents during the proceedings of the case. Date of Decision 16^TH JULY, 2013.

            The Reason for This application is, I am one of the 3338 person affected by this judgment and now it is came to my knowledge that in original Writ Petition No.5608 of 2007, the applicants & Respondents furnished incorrect and wrong information, hence this application to get the pleadings and documents submitted by the applicants in their petition and Rojnama.

Today our Case is heard in Mumbai CAT Court.

Our Advocate brought to the notice of the court that besides statuesque granted by the court, next spell of Officiating order due from 3^rd July 2015 is not issued by the CGMT MHT Circle.

BSNL Advocate objected on the information stating that, it is new issue to gain the sympathy of the court.

Court rejected the objection and noted the information.

We have also informed to the court about submission of our written statement to Mumbai CAT as per Court order during last hearing.

BSNL Mgt. also submitted their statement.

Finally court decided to reserve the judgment.

Date of Judgment will be declared shortly.
