Dear friends,
Mumbai CAT Court case is heard on 24th July 2015, before Hobl. Judges Smt. Mujumdar & Smt. Bhamsi arguments of both the parties heard by the court.
AGM Staff and other three officers of Legal Section of CGMT MHT Circle also attended case hearing as per Court order.

It was a very painful and shocking experience. BSNL Advocate in consultation with present BSNL Authorities tried to submit misleading and illegal information about case before the court.
But fortunately our Advocate not only succeeded in producing factual information, but also firmly produced information about similar attempt of BSNL Administration during the Civil Writ Petition No.5608 of 2007 In the Punjab & Haryana High Court with documentary evidence.
Due to the contradictory information’s from the both Advocates, court ordered to both Advocates to produce written submission within one week’s time. Case will again examine on 14th August 2015.

BSNL Officers present for court case hearing submitted some documents to the court, besides our several requests and their bound duty arrogantly refuse to give the copies of papers submitted to our Advocate.
Considering the act of BSNL officers we may submit the complaint to court against CGMT Maharashtra to produce misleading information before the court.
We also met ABG Consultant Advocates regarding filing perjury case. Case will be field as soon as documentation process completed.

The Third Notice of Hearing is served by the Central Information Commissioner, New Delhi on our complaint against CPIO of BSNL CGMT Haryana & CPIO BSNL Corporate Office on 16th July 2015.

The Online hearing is fixed on 14th August 2015 through Video Conference at NIC Computer Centre, Collect orate Office Nashik for applicant and,
NIC Studio, mini Secretariat, Ambala City for CPIO of BSNL CGMT Haryana, before Honorable Shri. Basant Seth, Information Commissioner, New Delhi.

I received the reply from CPIO BSNL Corporate office. The information sought is not provided by the CPIO besides the order of Chief Information Commissioner.
We have submitted the complaint against both CPIO’s on 16th July 2015.

            Information sought but not provided despite the direction from Honourable Chief Information Commissioner after the appeal was allowed.

Copy of Note sheets & the correspondence with reference to the communication referred above made with Corporate Office. Received.

Copy of Note sheets for letters & all correspondence culminated in the decision for implementing the court order of High Court Punjab & Haryana without filing SLP in Supreme Court.    Not received in spite  of


Decision Notice, passed by Honourable Chief Information Commissioner
while disposing off the appeal dtd. 19/01/2015.
                       
            The CPIO should forward the relevant part of the appellant’s RTI query to Corporate Office and should ensure that the information is supplied to him within 15 days from the receipt of this order.
                                   
             In compliance of the decision of Honourable Chief Information Commissioner, the CPIO & GM (HR/ADMIN) of Haryana forwarded the papers to, Addl. GM(MIS) & CPIO BSNL Corporate Office New Delhi on 1/05/2015. Requesting CPIO Corporate office to furnish the information directly to the applicant from his end.
            
Despite of the direction of Honourable Chief Information Commissioner that,  He should forward the relevant part of the appellant RTI query to corporate office. And should ensure that the information is supplied to him within 15 days, of receipt of this order.
            
Both the CPIO’s of Haryana Circle & Corporate Office wilfully and deliberately did not provide the information sought as detailed below.
            
             The reply received from CPIO BSNL Corporate office, clearly shows the CPIO chose to forwarded the letter asking for information to a Junior Officer AGM (Estb)-IV though the case was dealt by AGM( Pers)-IV ,and who have find the order No. F.No.3/9/2007/Pers-IV dtd. 11/11/2008 convening the decision of BSNL implementing the decision of High Court of Punjab & Haryana. The act of the CPIO amounts to deny the information sought by simply endorsing the letter of the Junior officer informing “Asked information is not clear to reply under RTI Act 2005.”
            
Further the appellant submit that after reaching second appeal stage and two hearings with Honourable Chief Information Commissioner the direction of CPIO corporate office to appeal to a much junior officer to Hon’ able Chief Information Commissioner tantamount to mockery of the RTI Act 2005 itself.
             The appellant further submit, at the first instant of my application for information the CPIO Haryana Telecom Circle should have transferred the application or such part of it as may be appropriate to that other public Authority and informed the appellant immediately about transfer as per Sec. 6(2)(ii) of RTI Act 2005, which was deliberately not done by CPIO, Haryana Telecom Circle.
            Further CPIO of Haryana Telecom Circle forwarded the copy of Honourable Chief Information Commissioner decision taken in the second hearing held on 20th April 2015, enclosing copy of the order issued by corporate office implementing Punjab & Haryana High Court decision About  this letter  only the information was sought by the appellant which includes “the copy of Note Sheets for letter and all correspondence culminated in the decision to implement the court order of Hon arable High Court of Punjab & Haryana without filling SLP in the Supreme Court.”
             Now the appellant submit that in the circumstances  this is a fit case to impose suitable penalty under Sec. 20 of the RTI Act2005 for not providing the ordered information and knowingly giving misleading information , thereby the CPIO s’ obstructed furnishing information.

Dear friends,
Mumbai CAT Court case is heard on 3rd July 2015, before Hobl. Judges
Smt. Mujumdar & Smt. Rohi.
Contenuous  two hours arguments of both the parties heard by the court.
Case is posted to 24th July 2015, for further discussion on contradictory Judgements of Chandigadh High Court & Chennai High Court.

We also met ABG Consultant Advocates regarding filing purjury case. According to Advocate The draft of Notice of Purjury will be prepared in next week.
We will try to issue the notice before the final hearing of Mumbai CAT court case scheduled on 24th July 2015.
We appeal all Officiating JTO’s to participate in perjury case.
